We are Edward (Son) and Roxanne (Mother / Widow). We are law-abiding U.S. Citizens without any Criminal Record.
In October 2014, we signed 7-month Apartment Lease with Airbnb Landlord Stefan Barry in Erving, MA. We immediately paid $1,300 for initial 6 weeks rent and moved in.
Three weeks later, Airbnb Landlord Stefan Barry and his Mother Joan Barry cancelled our Lease without any reason and demanded we move out immediately!
According to Massachusetts Laws, the Landlord can only evict the Tenant for "Non-Payment of Rent" or "Illegal Activity." First, the Landlord must provide "Notice to Quit" to Tenants demanding to pay "past due rent" or face Eviction. We were always ready to pay our rent, but the Stefan Barry and Joan Barry refused to accept our money! The Landlord never served us "Notice to Quit".

In November 2014, Stefan Barry and Joan Barry's Attorney Lawrence J. Farber (Farber-Lindley LLC) filed an Eviction Case against us (without "Notice to Quit"). The Attorney attached fraudulent Airbnb document. The Attorney claimed we rented the apartment for a few weeks and now refuse to leave!
Due to our difficult financial situation, we were forced to defend by ourselves (Pro-Se).
December 27, 2014: We filed "Motion to Dismiss" due to Massachusetts Tenant Rights violations and fraudulent Airbnb document.

January 9, 2015: Western Housing Court Judge Dina E. Fein rejected our 7-month Airbnb Apartment Lease with Bank Statements and denied our "Motion to Dismiss." Judge Dina E. Fein accepted Landlord's fraudulent Airbnb document and ordered the Case to Trial.

February 13, 2015: Western Housing Court Judge Dina E. Fein ordered us to Mediation in a tiny, poorly-ventilated room. Landlord's Attorney Carl W. Lindley Jr was very friendly and compassionate. He said: "You are such good people. I want to help you with this. We can do it today!"
After two hours we verbally agreed on several terms: We would pay $2,000 rent for March/April 2015 and move out by May 1, 2015. But if we fail to pay any rent, we are responsible for $2,400 plus court costs on May 1, 2015.
Attorney Carl W. Lindley Jr compiled a fraudulent Settlement Agreement with covert $2,400 bonus for his Client Joan Barry. Unfortunately, we could not understand the Attorney's scribbles and asked him to read the document out loud. Based on Attorney's swift reading, the document matched the verbal agreement and we signed it.
March/April 2015: To obey the "Settlement" Terms, we paid $2,000 rent to the Landlord Attorney. I (Edward) was laid off from my Programmer job. Dozens of Landlords refused to rent us an apartment while Eviction Case is "active."
On May 1, 2015 Court Hearing, we discovered that Landlord Attorney Carl W. Lindley Jr compiled a fraudulent "Settlement Agreement" with covert $2,400 bonus to his Client Joan Barry. We told Western Housing Court Judge Dina E. Fein about this fraud. But Judge Fein was completely biased toward the Landlord Attorney. She ordered immediate eviction, $2,400 plus Court Costs (with accruing interest).
Three times, we asked the Western Housing Court Judge Dina E. Fein if March/April $2,000 rent payment is included in $2,400 Judgment. Three times Judge Fein refused to answer! Then Muscular Court Bailiff threatened me (Edward): "Stop talking or I will arrest you!"
We believe that the Final Judgment is a "Fruit of a Poisonous Tree" and immediately filed an Appeal at Massachusetts Appeals Court.
To obey Judge Dina E. Fein's Order, we swiftly moved out of Landlord's apartment. We collected money for a new apartment. But now we were forced to check into Motel. Three months later, we exhausted all our money and became homeless.
February 6, 2018. Previously, we wrote how Landlord's Attorney compiled a fraudulent "Settlement Agreement" with secret bonus ($2,400) for his Client. Judge Dina E. Fein ordered that we pay all of it plus Court Costs! We were financially ruined and became homeless. Three years later, we collected the money to pay off Judge Dina Fein's fraudulent Judgment. But Landlord Attorney Carl W. Lindley Jr demanded we pay additional $800 in Interest! Another Boston Attorney and Court Clerk told us: The Interest is optional (at Landlord Attorney's discretion). But Attorney Carl W. Lindley Jr refused to waive the Interest! We had no choice but to pay this absurd "Fruit of the Poisonous Tree" Final Judgment ($3,440 cash in full). Now, the fake Eviction Case against us is CLOSED!
